§ 15.08.030. Definitions.

  • The following definitions shall apply in the interpretation and enforcement of this chapter:

    1.

    Singular/Plural/Gender. As used in this code, the singular form of a word includes both the singular and plural, and reference to words of a certain gender includes reference to all genders. Use of the word "and" shall mean both subjects and shall not be construed to mean "or".

    2.

    Meaning of Certain Words. Whenever the word "dwelling," "dwelling unit," "rooming house," "rooming unit," "premises," are used in this chapter, they shall be construed as though they were followed by the words "or addition thereto, or any part thereof."

    3.

    "Designee" means any other city employee whose duties and responsibilities encompass the purposes of this code and who is under the charge of the building inspector or city inspector. All designees shall be identified in writing and kept on public record, available for public inspection. Each health officer, and their respective designees, shall be issued an identification badge and identification card, which will specifically identify him and his authority, and include his picture which shall have been taken within the last twenty-four months. He shall keep on his person at all times during the performance of his duties, and shall display upon request of any occupant or owner, during the performance of his duties, his badge and identification card. For purposes of this code, each designee shall be designated as a designee of either the building inspector or the city inspector, but not of both. A designee may act or substitute only for the particular health officer for which he is designated. If a requirement of this code requires both health officers, substitution by designees requires one for each health officer.

    4.

    "Dwelling" means any building which is wholly or partly used or intended to be used for living or sleeping by human occupants, including, but not limited to, those businesses designated or holding themselves out as hotels, motels, and rooming houses; provided, that temporary housing, as hereinafter defined in subsection 23, shall not be regarded as a dwelling, nor shall this chapter apply to any federally-maintained public housing.

    5.

    "Dwelling unit" means any room or group of rooms located within a dwelling and forming a single habitable unit with facilities which are used or intended to be used for living, sleeping, cooking and eating, except for federally maintained public housing.

    6.

    "Extermination" means the control and elimination of insects, rodents or other pests by eliminating their harborage places, by removing or making inaccessible materials that may serve as their food; by poisoning, spraying, fumigating, trapping; or by any other recognized and legal pest-elimination methods approved by the health officer.

    7.

    "Garbage" means the animal and vegetable waste resulting from the handling, preparation, cooking and consumption of food.

    8.

    "Habitable room" means a room or enclosed floor space used or intended to be used for living, sleeping, cooking or eating purposes, excluding bathrooms, water closet compartments, laundries, pantries, foyers, or communicating corridors, closets and storage spaces.

    9.

    "Health officer" means the building inspector or city inspector as defined in Granite City Municipal Code, Title 2, Chapters 2.16 and 2.26 respectively. Reference to "health officers" means the building inspector and city inspector.

    10.

    "Infestation" means the presence, within or around a dwelling, of any insects, rodents or other pests.

    11.

    "Multiple dwelling" means any dwelling containing two or more dwelling units.

    12.

    "Occupant" means any person, over one year of age, living, sleeping, cooking or eating in, or having possession of, a dwelling unit or rooming unit.

    13.

    "Operator" means any person who has charge, care or control of a building or part thereof in which dwelling units or rooming units are let.

    14.

    "Ordinary minimum winter conditions" means the temperature fifteen degrees Fahrenheit above the lowest recorded temperature for the previous ten-year period.

    15.

    "Owner" means any person who, alone or jointly or severally with others:

    1.

    Shall have legal title to any dwelling or dwelling unit, with or without accompanying actual possession thereof; or

    2.

    Shall have charge, care or control of any dwelling or dwelling unit, as owner or agent of the owner, or as executor, executrix, administrator, administratrix, trustee or guardian of the estate of the owner. Any such person thus representing the actual owner shall be bound to comply with the provisions of this chapter, and of rules and regulations adopted pursuant thereto, to the same extent as if he were the owner.

    16.

    "Person" means and includes any individual, firm, corporation, association or partnership.

    17.

    "Plumbing" means and includes all of the following supplied facilities and equipment: gas pipes, gas-burning equipment, water pipes, garbage disposal units, waste pipes, water closets, sinks, installed dishwashers, lavatories, bathtubs, shower baths, installed clothes-washing machines, catch basins, drains, vents and any other similar supplied fixtures, together with all connections to water, sewer, or gas lines.

    18.

    "Premises" means any dwelling, dwelling unit, multiple dwelling, rooming house or rooming unit, or addition thereto, or part thereof.

    19.

    "Rooming house" means any dwelling, or that part of any dwelling containing one or more rooming units, in which space is let by the owner or operator to three or more persons who are not husband or wife, son or daughter, mother or father, or sister or brother of the owner or operator.

    20.

    "Rooming unit" means any room or group of rooms forming a single habitable unit used or intended to be used for living and sleeping, but not for cooking or eating purposes.

    21.

    "Rubbish" means combustible and noncombustible waste materials, except garbage; and the term shall include the residue from the burning of wood, coal, coke and other combustible material, paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals mineral matter, glass crockery and dust.

    22.

    "Supplied" means paid for, furnished or provided by or under the control of, the owner or operator.

    23.

    "Temporary housing" means any tent, trailer or other structure used for human shelter which is designed to be transportable and which is not attached to the ground, to another structure, or to any utilities system on the same premises for more than thirty consecutive days.

    24.

    "Single-family" means the immediate family which may consist of only one married couple, their children, parent, cousin, grandparent and a maximum of two other persons whether or not of the immediate family. Exceptions may be allowed so long as the number of persons residing in the dwelling unit do not exceed a reasonable number considering the sleeping rooms and area available for living space. The city inspector and the building inspector shall use reasonable discretion in approving exceptions.

    25.

    "Single-family owner-occupied dwelling" means a dwelling unit designed for and/or occupied by a single family. A condominium unit is considered a dwelling unit.
